CAT CHAT: Veterinary Hospital Starts Michigan's First Pet Hospice ...

In 2007, ?when ?my Angel Bobo was facing the final days of his life, just prior to turning 18, (he passed one day after his 18th birthday), I was faced with many agonizing decisions. Wanting to preserve his dignity and lessen his suffering, ?and after his communication to ME "?that yes it was time," (which he told me AFTER I held him and told him I would be ok, ?and to please not worry. Bobo's life was spent protecting me and I knew he would never cross the bridge without knowing I would be ok), ?I chose to help him cross the bridge in the safety and love of our home, on our couch.

Bobo had been ill with feline heart issues and deteriorating kidney function for two years prior to the day I made the heartbreaking decision. In one sense, I was blessed that his worst days didn't go on for months, so had a Pet Hospice existed at that time I am not sure it would have been a necessity for me. Bobo had become deaf, he was inactive, his breathing labored, my formerly "I-live-for-my-Mama-and-for-food" cat had stopped eating. My beloved Bobo ? no longer had a good quality of life. Had things been different and Pet Hospice existed, I might have looked into it.

The Cat Practice hospice in Birmingham, Michigan, ?will offer end-of-life care, modeled after human hospice that alleviates physical discomfort and provides a caring end-of-life experience for the pet and the pet?s family. Like human hospice, The Cat Practice hospice is for families whose pets face an incurable condition, but can still enjoy quality of life.??Instead of?curative?treatment, pets receive?palliative,?or comfort care, that includes medication for pain and discomfort, physical affection, favorite foods and extra time with family members.Pets in the hospice program receive care at home under the direction of The Cat Practice veterinary hospice nurse Laura Kramek.? Families are taught how to administer care and have a regular pipeline in to Kramek for guidance and support. They also get reduced pricing on office visits and pet pain medications.? Psychologist Dr. Camille Greenwald, who works with The Cat Practice, is available for grief counseling. ??Future plans include a memory wall on the hospital?s website for remembering deceased pets.?Cats are living 20 years and more,? says Kramek.? ?Conditions once considered untreatable ? kidney failure, heart disease, diabetes, thyroid disease ? can all be managed today."?To help pet owners prepare for caring for an aging pet, The Cat Practice will hold parts 3 and 4 of a 4 part workshop series, Pet?Hospice Care (June 13), and Greenwald on Pet Loss and Grieving (June 27).? Donation is $10 per workshop or $25 for the series with proceeds going to The Cat Practice?s Rufus Memorial Feline Fund for cats in need.? To register, go to www.thecatpracticepc.com?

or call 248-540-3390.

?"Emotionally speaking, losing a pet is not very different than losing anyone else we love,? says Dr. Greenwald.? ?Therefore, having some understanding of the normal grieving process and commonly associated feelings can help people navigate their way through what is a painful but very natural and normal life process."?Pets touch people?s lives and hearts in so many ways,? says Kramek.? ?Today, saying good bye can be a time to continue this bond.? As long as a pet is comfortable and still enjoys quality of life, pet families have choices and that is what we want to give them.??

While The Cat Practice just recently formalized its hospice program, the hospital has been providing clients and their felines with options for end-of-life care for a number of years.?? In fact, it was clients asking for alternatives that led to the program.

Kramek is a veterinary hospice nurse and licensed veterinary technician (LVT) with a special interest in geriatric pets, pet hospice and end-of-life care.? She works closely with pet families to help them know all of their options.? Kramek has been with The Cat Practice since 1993 and is a graduate of Michigan State University.?? She and her husband live in Dearborn Heights with their two cats Epoisses and Pinot.

About Camille Greenwald, PhD.Dr. Greenwald is a licensed clinical psychologist.? She has been in private practice in Birmingham for 20-plus years, and has served as a consultant at William Beaumont Hospital.? She is a graduate of?Wayne State University and the University of Detroit and is also a member of the American Psychological Association and the Michigan Psychological Association.? Dr. Greenwald, a life-long cat owner,?shares her home with her family and three cats: Caspurr, Henry?and Bill?who is geriatric. The Cat Practice, Michigan?s first cats-only veterinary hospital, opened in 1981.? Open seven days a week and evenings, The Cat Practice provides advanced preventative and medical care with an emphasis on early detection to help cats live longer, better and healthier lives.? Located at 875 South Worth in Birmingham, Michigan, The Cat Practice cares for feline purebred and mixed breeds from around southeastern Michigan.?? For information go to www.thecatpracticepc.com or call?

I am interested in hearing your thoughts. If a Pet Hospice existed in your area, would it be something that you would consider?

San Andreas Fault in Santa Cruz Mountains large quakes more frequent than previously thought

Recent paleoseismic work has documented four surface-rupturing earthquakes that occurred across the Santa Cruz Mountains section of the San Andreas Fault (SAF) in the past 500 years. The research, conducted by the U.S. Geological Survey, with assistance from the California Geological Survey, suggests an average recurrence rate of 125 years, indicating the seismic hazard for the area may be significantly higher than currently recognized. The observations help fill a gap in data on the seismic activity of the SAF in northern California, particularly south of San Francisco.

Geologists Thomas Fumal and Tim Dawson conducted paleoseismic studies at Mill Canyon, near Watsonville, California. They documented evidence for four earthquakes, the most recent being the 1906 M 7.8 San Francisco event. They conclude that each of the three earthquakes prior to the 1906 quake was a large magnitude event that likely ruptured most, or all, of the Santa Cruz Mountains segment, producing similar physical deformation as the 1906 quake.

In addition to filling in a data gap about the SAF in this region, this research adds to the understanding of how the SAF behaves, in particular whether individual segments of the fault system can produce destructive earthquakes and how often. This study joins to a growing body of work that suggests the SAF produces a wider array of magnitudes than previously appreciated in the current seismic hazard models.

Seattle Fault Zone 900-930 AD earthquake larger than previously thought

A fresh look at sedimentary evidence suggests the 900-930 AD rupture of the Seattle fault possibly produced a larger earthquake than previously recognized. The Seattle fault zone, a series of active-east-west trending thrust faults, poses seismic threat to the Puget Sound region.

The 900-930 AD rupture is the only known large earthquake along the Seattle Fault, making geological records of prehistoric events the only clues to the earthquake potential of the fault.

While a graduate student at the University of Washington, Maria Arcos looked at tsunami and debris flow deposits both evidence of a paleo-quake in the coastal marsh at Gorst, Washington. She also identified evidence of at least three meters of uplift that preceded a tsunami, which was followed by a sandy debris flow from Gorst Creek, and suggests that the 900-930 AD quake covered a greater geographic area than previous fault interpretations.

The revised height and width of deformation caused by the quake may influence current interpretations of the Seattle fault's structure. This study found a minimum of three meters of uplift at Gorst, which is double the amount of previous fault models for the same location. A broader zone of deformation, says Arcos, may indicate either a wider zone of slip along the dip of the fault, a shallower dip or splay faults farther to the south.

Two minutes? Seriously? Part 2: The Nuts and Bolts ? David Otey

Two minutes? Seriously? Part 2: The Nuts and Bolts

31 May 2012?|? Posted by?David Otey?|? 0 Comment.

In Part 1 of this lesson, I address the challenge of the two-minute report at the conceptual level. In that message, I urge you ? the speaker or presenter ? to place the audience?s needs ahead of your own in deciding how to make the best use of your limited time at the lectern. The framework for considering those needs can be expressed by the ?three C?s? ? connection, context, and consequence. Here they are again, in brief:

Connection ? Why is this important to you, the speaker? If I feel a personal connection with you, and I can see that this topic matters to you, then I am more likely to be engaged.

Context ? Why was someone assigned to do this work in the first place? What is its relevance to the larger effort of this body?

Consequence ? Why is it important to me, the audience member? What decision will I need to make, or what action will I take, which might be influenced by what you have to say? If the answer to both questions is, ?Nothing,? then you really ought to reconsider taking time in the program and making a demand on my attention. If you are not there to make a difference, why are you there?

Once you buy the concept of this framework, there is still the question of how to fit your message into your allotted time. The rest of this article covers the ?nuts and bolts? of the process. Given the importance of time limits due to the sheer number of presentations, you demonstrate your respect for the audience and your fellow presenters by following this process.

The process relies for its success on a single overarching principle to which there can be no exception: YOU MUST WRITE IT DOWN! No matter how many times you have spoken in front of an audience, DO NOT give in to the temptation to ?wing it.? Even experienced speakers cannot be counted on to fit their remarks into a tight time limit while working from an outline.

Writing out your remarks ahead of time does not mean that you have to read them. What it does mean is that you will have a written script that you can use when you PRACTICE your presentation. Furthermore, there are three distinct benefits to be gained from writing out your remarks:

1. A speech that is written is a speech that can be edited. By ?edit? I do not mean simply to cut or to shorten, as the word is often used. I mean to revise ? to wordsmith ? to polish. There is no way to edit a speech that does not exist until you give it; therefore, you must write it in order to have a starting point for improvement. Great speeches aren?t written; they are re-written.

2. Writing your speech is the best way to reveal and correct its structural flaws. As you read through what you have written, you should be able to see where your points do not flow logically. If you find yourself saying, ?Again?? or ?As I said?? then you must eliminate these time-wasting statements and figure out how to re-order your points so that there is no need to repeat yourself.

3. Writing a speech is the best way to know ahead of time how long it will be. There is a very simple rule you can follow. While only an approximation, it is a good one. American men tend to speak about 125 words per minute, on average, while women average about 150 words per minute. Therefore, if you are given two minutes in which to speak, you must get your speech down to about 250 or 300 words depending on your gender. There is no getting around this. If you respect the event and its need for time limits, the numbers don?t lie. (I happen to know that my speaking rate is about 135 wpm. If you know your own rate, you can use that information instead of the approximation above.) If you are using Microsoft Word, your word count appears in real time at the bottom left-hand corner of your screen; I?m sure other programs do something comparable.

?But I don?t write the way I speak!? you say, and I congratulate you for that awareness. It takes practice to write in your speaking voice. However, there is a very simple way around this problem. Create your outline, write out your opening and closing lines, and then talk through your speech into a voice recorder. Transcribe what you said, and there is your written, first draft.

Now that you have your first draft, begin tightening it up. Structure your points so you don?t repeat yourself. Eliminate unnecessary details and back-story. Let go of the need to explain everything; give your audience credit for their existing knowledge and intelligence. Careful wording of your transitions will make it easy to follow your points without repetition. Use precise verbs, to keep adverbs to a minimum. Use the active voice whenever possible (?Everyone had a good time?), not the passive voice (?A good time was had by all?). Keep sentences short: you should speak in shorter sentences than you write.

Let?s assume you have done all these things and your speech is still too long. Now what?

It all comes back to the audience. Ask yourself this question: ?When I am finished, what do I want my listeners to think, do, or feel differently?? The answer to that question is your Specific Purpose in speaking. Until you can answer that question, you are not ready to speak. Once you do know the answer, you must use it as a filter. Anything that does not directly contribute to that purpose ? to making that difference ? needs to be taken out.

What this means, ultimately, is that of the ?three C?s,? the last one trumps the other two. However, even in a two-minute report, you should be able to devote a sentence or two to making a connection and establishing a context. Still, the most important question in the listener?s mind will be, ?What difference does this make to me?? Provide a clear answer to that question, and you will earn your audience?s gratitude.

To sum up the process:

  1. Answer the ?three C?s? questions.
  2. Create your first draft ? using the record-and-transcribe method if necessary.
  3. Edit the first draft for structure and efficient language, thus creating your second draft.
  4. Apply the Specific Purpose test to filter out everything that does not contribute to the difference you want to make.
  5. When your polished draft is down to 250-300 words (or two minutes at your speaking rate), congratulations. Now practice it.

The gambler who hasn't made the list - yet - 24th May 2012

An honorarble mention in this year?s Rich 200 must go to David Walsh. While his estimated wealth falls short of the $210?million cut-off in this year?s ranking, the Taswegian stands out this year for his ability to make Australians feel uneasy.

It?s not just the contents of his Museum of Old and New Art (Mona), perched on the banks of the Derwent River just outside Hobart, with its excrement-producing Cloaca exhibit, display of human ashes and artist Chris Ofili?s The Holy Virgin Mary depicting the mother of Jesus surrounded by female genitalia and including elephant dung that will discomfort some.

It is the fact that in a year when arguments about gambling reforms have drawn vicious lobbying from the pubs and clubs industry and threatened to bring the machinery of parliament to a halt and when there?s growing concern about gambling generally that Walsh has so overtly used a fortune accrued from wagering to build a temple to art ? celebrated by many of the same people who decry gambling.

In fact, the country?s largest private museum, which opened early last year, has contemporary Australian art fans salivating. Its contents include Sidney Nolan?s Snake, a 46-metre-long, nine-metre-high collation of 1620 different painted panels, and works by Brett Whiteley, Arthur Boyd, Charles Blackman and Russell Drysdale. Mona also treads solidly into ancient territory with the mummy and coffin of Pausiris and a cast bronze votive figure of Isis and the Infant Horus, from 600-300BC.

The public loves it. Mona drew more than 330,000 visitors last year ? almost half from outside Tasmania. The collection is doing great things for tourism to the Apple Isle and for Australia as a whole.

?The only time I can think of in recent history that [we had] something this big, audacious, generous and gifted was probably in America,? Edinburgh Festival director Jonathan Mills gushed last year. ?It?s the Getty, the Guggenheim, it?s on that level.?

And yet, revelations that Walsh?s $175?million project was funded in part by his friend and fellow gambler Zeljko Ranogajec, whose gambling syndicate makes money out of the rebates that totalisers give in exchange for placing large bets ? reducing the pool of winnings for ordinary punters placing smaller bets ? only adds to the unease.

It?s no doubt a contradiction the private Walsh enjoys. If he were a miner or industrialist, his generosity would be unambiguously celebrated. That?s the sort of background Australia has come to expect of its arts patrons. Still, taking from the poor and giving to middle-class causes is something state-owned lotteries have always done. Walsh could argue he is doing the redistribution more directly, by cutting out the need for a lot of grant applications. Or he might not.

?I invent a gambling system,? Walsh writes in the introduction to his book Monanisms. ?Make a money mine. Turns out it ain?t so great getting rich using someone else?s idea. Particularly before he had it. What to do? Better build a museum; make myself famous. That will get the chicks.?

The extent of Walsh?s own fortune is unclear. He has a collection of properties in and around Hobart, one of which he co-owns with Ranogajec, along with the premium Moorilla Estate winery and vineyard and Moo Brew brewery.

It remains to be seen how Walsh views his own cash flow. Is Mona, with its stated $100?million worth of artworks, simply vanity spending? Is Walsh a patron in the traditional sense or should this be seen as an initial investment into a new realm of money-making ventures?

Features of the museum, with its iPod-based self-guide system, which explains exhibits while simultaneously collecting useful data for curators on what visitors are viewing and the length of time they spend at each artwork, along with a bar in the museum selling Moo Brew beers and Moorilla wines lend themselves to replication. A side project is the 10-day Mona Foma (Festival of music and art), which this year ran for the fourth time.

It may all be just another investment. The 50-year-old Walsh has already said in interviews he intends to exploit his high-profile attraction.

?I want to use Mona as a marketing tool to drive some products that I hope will make some serious money.? (Fairfax Media)

Police say teen in fatal Louisiana crash was drunk | Baton Rouge ...

A new police report claims that the 19-year-old driver responsible for a crash that left him and another teenager dead, was drunk at the time of the accident. Louisiana law allows drivers under the age of 21 to have a blood alcohol content of 0.02 percent or lower, but the police report shows that the driver's BAC was 0.22 percent. This was more than 11 times higher than the legal limit for a driver his age and over two times higher than the national legal limit of 0.08 percent. The teenagers were on their way to get breakfast following a party at a hotel.

While the driver was killed in the crash, the family of the other victim could have filed a wrongful death lawsuit against him had he lived in effort to collect compensation for the loss of their loved family member. It is unclear whether the family of the victim, who tested negative for alcohol, has any legal action planned. Additionally, the families of both victims could file wrongful death lawsuits, as the intersection where the crash occurred has been called dangerous by politicians and safety advocates.

Police say the fatal accident occurred when the driver failed to stop at a stop sign, driving into the path of an oncoming semi-truck. The truck's 68-year-old driver had already entered the intersection and was unable to stop his vehicle in time. The truck driver was uninjured.

Following the accident, the father of one of the victims testified before the Louisiana House of Representative's Transportation Committee, hoping to see efforts to improve safety at the intersection.

Louisiana residents who have lost loved ones to car accidents should contact a qualified personal injury attorney to find out more about the legal options available to them. They may be able to recover damages to compensate them for the pain and grief caused by their losses.

Mad Men, Season 5

But as happy as I am for Peggy to go thrive elsewhere, as a viewer of this series, I?m sorry to see her go. It?s easy to think of Mad Men as Don Draper?s show, but really for the first four seasons it was Don and Peggy?s both. Their successes and failures, personal and professional, were frequently linked: Think of Peggy bailing Don out after his car wreck with Bobbie Barrett, or of Don?s pep talk to Peggy after the birth of her child. They knew each other?s secrets, respected each other?s talents, and did great work together, even if Peggy didn?t always feel she got the credit she deserved. It?s hard to imagine watching Don go on without his true work wife at his side. ?What, all of a sudden we care about each other?s lives?? Peggy snaps at Cosgrove when he tries to console her after the money-tossing incident. Peggy?s acknowledging a truth made all too clear in this episode: At SCDP, it?s every man for himself, and even a colleague?s dignity can be auctioned off if it means landing a car. But I believe Don and Peggy did care about each other, in a way few other characters in this office do. (If you thought Roger felt that way about Joan, you were sorely disappointed last night.)

Consumer confidence in the economy plunged in May

NEW YORK (AP) ? Here we go again.

Americans confidence in the economy suffered the biggest drop in eight months as worries about the weak jobs, housing and stock markets rattled them again. The decline comes after a few months of optimism amid some positive economic news.

The Conference Board, a private research group, said on Tuesday that its Consumer Confidence Index now stands at 64.9, down from a revised 68.7 in April. With gas prices falling, Americans were expected to push the measure to 70, according to analysts polled by FactSet.

But the May figure, which represents the biggest drop since October 2011 when the measure fell about 6 points, shows that consumers need more encouraging economic signs before their concerns start to dissipate. Americans remain worried about slow hiring, declining home values, big drops in the stock market and a worsening European economy that they fear will negatively impact the U.S.

"Consumers were less positive about current business and labor market conditions, and they were more pessimistic about the short-term outlook," said Lynn Franco, director of economic indicators at The Conference Board.

Consumer confidence is widely watched because consumer spending accounts for 70 percent of economic activity. May's figure is significantly below the 90 reading that indicates a healthy economy. The measure hasn't been near that level since December 2007. But the latest reading is still well above the 40 figure reached last October and the all-time low of 25.3 in February 2009.

The consumer confidence measure has zigzagged so far this year, dropping in January, rising in February and holding nearly steady after that. Analysts were hoping a slight rise in May would give some credence to the idea that the economy is stabilizing.

Instead, the data, which was based on a survey conducted from May 1 through May 16 with about 500 randomly selected people nationwide, suggests that "the pace of economic growth in the months ahead may moderate," said Franco, with The Conference Board.

Mark Vitner, an economist at Wells Fargo, said May's reading is disappointing, but consistent with the sluggish economic recovery so far.

"In some ways, it's a microcosm of the whole economic recovery," he said. "Every once in a while hopes are raised that things are getting better and then the bottom seems to fall out again."

Analyst say the dismal job market is what keeps Americans from being confident. Indeed, U.S. job growth remains inconsistent.

Hiring picked up earlier in the year, but slowed in March and April, suggesting the economy's early-year momentum faded in early spring. Economists say a warm winter led employers to move up some hiring and accelerate other activity that normally wouldn't occur until spring.

A clearer picture of the jobs market will emerge on Friday, when May employment figures are due out. The unemployment rate is expected to remain at 8.1 percent for May with an increase of 160,000 jobs, according to FactSet. That's above April's gains but below the growth pace set this winter.

Adding to Americans' job woes, the stock market in May is on track for its worst month since last September. The S&P 500 is down 4.6 percent for the month. But on Tuesday, The stock market appeared to shrug off the report. The Dow Jones industrial average was up 110 points when the report was released at 10 a.m., and climbed 20 points higher after it came out.

That indicates investors may be more confident in the economic recovery than consumers, said John Lonski, chief economist of Moody's.

"Financial markets are giving short shrift to the drop in consumer confidence," Lonski said.

Meanwhile, recent signs that an economic slowdown is spreading beyond Europe to fast-growing countries like China has raised fears that U.S. companies could pull back on hiring as demand weakens for their products. The housing market also is still weak, and many consumers are seeing their retirement plans shrink as stock prices fall.

Conversely, shoppers are getting some relief at the gas pump. Gasoline has dropped 27 cents per gallon since early April. The national average was $3.67 per gallon as of the start of the Memorial Day weekend on Friday; some experts say it could fall as low as $3.50 by July 4.

RIM's top lawyer joins parade of resignations

TORONTO (Reuters) - The top lawyer at Research In Motion Ltd has resigned and will soon leave the struggling BlackBerry maker, RIM said on Monday, joining a parade of long-time company executives to depart since Thorsten Heins took over as CEO earlier this year.

The loss of Chief Legal Officer Karima Bawa - who litigated numerous patent disputes and helped write many of RIM's commercial deals - follows the resignation of RIM's head of global sales, Patrick Spence, last week.

"Thorsten Heins is reframing the RIM organization. Not everyone will fit into the new picture," said IDC analyst Kevin Restivo. "Departures, forced or otherwise, are inevitable anytime management sets a new course for an organization."

The resignations come ahead of what are expected to be massive layoffs this year as the company prepares to launch BlackBerry smartphones run by an operating system completely different from that used in its legacy phones.

RIM's shares have fallen some 75 percent in the last year while its market share has shriveled against competition from iPhone maker Apple Inc and a slew of manufacturers using Google Inc's Android operating system.

RIM's Toronto-listed rose 0.9 percent to C$11.34 late Monday afternoon. The company's Nasdaq-listed shares were not trading due to a U.S. holiday.

Bawa, who joined RIM in 2000, was promoted to general counsel and chief legal officer in late 2010.

She plans to stay with the company while a replacement is hired and during a transition, RIM said in an emailed statement after Reuters asked about Bawa's status.

Analysts and former employees have long complained about what they viewed as a hyper-cautious corporate approach at RIM. That grew out of a drawn-out patent dispute early in the company's rise and was exacerbated by the hiring of a slew of in-house lawyers afterwards.

CLEANING HOUSE

RIM is quietly cleaning out layers of management and recruiting fresh faces to fill important roles in a new structure being fashioned under Heins, who himself replaced longtime co-CEOs Mike Lazaridis and Jim Balsillie in January.

"Thorsten has a very different leadership style," said one former RIM employee who left several months ago. "He is picking a very specific organizational structure, inner circle, external hires and strategy, and a lot of folks aren't 100 percent comfortable with it."

The former employee spoke on the condition of anonymity to protect his ongoing business relationship with the company.

The Waterloo, Ontario-based company currently employs around 16,500 people globally. Two sources with close connections to RIM have told Reuters that RIM plans to bring its workforce closer to 10,000 by early next year.

The sources asked to go unidentified because their disclosures would hurt their relationships with RIM.

The cuts will affect RIM's legal, marketing, sales, operations, and human resources divisions, one of the sources said.

"The Research In Motion people have come to know is very likely to be a much smaller organization in the near future," said IDC's Restivo. "It's a reflection of the company's smartphone struggles. Call it an trailing indicator if you will."

RIM's share of the global smartphone market slipped to 6.7 percent in the first quarter of 2012 from 13.6 percent a year earlier, according to IDC.

A round of 2,000 job cuts was planned for around June 1, the day before the end of RIM's quarter, the Globe and Mail said on Saturday, citing several people close to the company.

Last July RIM said it cut 2,000 jobs, after its worker count ballooned to near 20,000 following a string of acquisitions in recent years.

Balsillie remains the departure with the highest profile. While cutting all formal ties to the company, he remains a major shareholder. Lazaridis is still influential on the board.

A chief operating officer, Jim Rowan, and the head of software David Yach left in March. Soon after, Alan Brenner, a senior vice president for the BlackBerry platform, and Alistair Mitchell, vice president for the BlackBerry Messenger instant messaging product, also left.

The head of RIM's India unit left in November, its head of government relations left months before that, and former chief marketing officer Keith Pardy departed more than a year ago.

RIM said this month it had replaced Pardy with wireless veteran Frank Boulben, who has yet to start work.

It has also named Kristian Tear as its single chief operating officer. He replaces Heins, who took the CEO job, Rowan, who departed, and a third operating head, Don Morrison, who retired last year.

District Court Invalidates DOMA and Related Care Insurance ...

In Dragovich v. U.S. Department of the Treasury,?(ND CA, May 24, 2012), a California federal district court held unconstitutional Sec. 3 of the federal Defense of Marriage Act and federal provisions (26 USC Sec. 7702B(f))?that effectively bar states from permitting same-sex domestic partners or same-sex spouses from participating in state-maintained long-term care insurance policies. DOMA was defended by the?Bipartisan Legal Advisory Group of?the United States House of Representatives (BLAG) since the administration refused to defend its constitutionality. ?In striking down the provisions, the court said in part:

the legislative record contains evidence of anti-gay?animus and the BLAG has failed to establish that ? 3 of the DOMA?is rationally related to a legitimate government interest. ?Accordingly, Plaintiff same-sex spouses are entitled to summary?judgment that ? 3 of the DOMA is invalid under the Constitution?s?equal protection principles to the extent that the law blocks?their access to the CalPERS long-term care plan....
Because Congress?s restriction on state-maintained long-term?care plans lacks any rational relationship to a legitimate?government interest, but rather appears to be motivated by antigay animus, the exclusion of registered domestic partners of?public employees from ? 7702B(f)?s list of individuals eligible to?enroll in state-maintained long-term care plans violates the?Constitution?s equal protection guarantee.

Experts: Remedial college classes need fixing

OVERLAND PARK, Kan. (AP) ? Each year, an estimated 1.7 million U.S. college students are steered to remedial classes to catch them up and prepare them for regular coursework. But a growing body of research shows the courses are eating up time and money, often leading not to degrees but student loan hangovers.

The expense of remedial courses, which typically cost students the same as regular classes but don't fulfill degree requirements, run about $3 billion annually, according to new research by Complete College America, a Washington-based national nonprofit working to increase the number of students with a college degree.

The group says the classes are largely failing the nation's higher education system at a time when student-loan debt has become a presidential campaign issue. Meanwhile, lawmakers in at least two states have pushed through changes and numerous institutions are redesigning the courses.

"Simply putting (students) in three levels of remedial math is really taking their money and time with no hope of success," said Stan Jones, president of Complete College America.

The group's research shows just 1 in 10 remedial students graduate from community colleges within three years and a little more than a third complete bachelor's degrees in six years. Yet the classes are widespread, with more than 50 percent of students entering two-year colleges and nearly 20 percent of those entering four-year universities put in at least one remedial course, the report said.

"At the end of the day if we could say that we are getting more students to graduate, particularly those coming into college without the requisite skills, the investment we have now is worth it," said Bruce Vandal, director of postsecondary education for the Denver-based Education Commission of the States, a nonpartisan group that researches education policy. "I think the fact that we aren't getting that result is why legislators and policymakers are up in arms and rightfully so."

The research comes as the cost of a college education continues to grow. The College Board said last fall that the average in-state tuition and fees at four-year public colleges rose an additional $631, or about 8 percent, compared with a year ago. The annual cost of a full credit load has passed $8,000 ? an all-time high.

Legislation passed earlier this month in Kansas prohibits four-year universities from using state funds to provide remedial courses.

Beth Gulley, an associate English professor who teaches remedial writing at the 22,000-student Johnson County Community College in northeast Kansas, acknowledges the remediation statistics are "pretty dismal." But she noted it sometimes takes students longer to graduate than the span of time the statistics track.

"I think there is lots of hope," she said.

Take her assistant Brandon True, who dropped a remedial math class twice before completing it and College Algebra. Now 23, he is taking a calculus-heavy class for aspiring video game designers and preparing to transfer to a four-year institution.

"I was terrified," he recalled of his earlier math struggles. Because of those initial struggles problems, he feels like he truly understands the remedial writing students he helps. "I think they choke. It's scary."

Research shows placement exams routinely misplace students in remedial courses, and colleges would do so far less often if they also examined high school transcripts, said Davis Jenkins, a senior researcher at the Community College Research Center at Teachers College at Columbia University in New York.

True knows the limitations of placement exams firsthand. He went from being identified as needing remedial writing help the first time he took the test to qualifying for the gifted writing program the second time.

The classes are being rethought as well. Jenkins recommends doing away with the one-size-fits-all college algebra requirement and having math classes tailored to a few broad areas of study. For instance, those studying history, law or psychology might take a math class focused more on statistics.

"It just kills their desire for learning," Jenkins said, noting that some students are being placed in classes that make them basically redo middle school pre-algebra. "There really is a stigma, so it is clear that we need to rethink it."

The Complete College America report also says research shows half or more of remedial students would be better off being placed in required classes and having the schools building in extra help, such as tutors or more frequent class meetings.

The report said institutions that have used those approaches have seen their unprepared students succeed at the same rates as their college-ready peers. Legislation passed earlier this month in Connecticut allows underprepared students to take full-credit, college-level courses with built-in supports, such as extended instruction, extra tutoring and mandatory labs.

"We're failing these students if we don't change," said Democratic state Rep. Roberta Willis, co-chairwoman of Joint Higher Education and Employment Advancement Committee in Connecticut.

Such an approach worked well for Jessica Grubb, 22, of the Round Rock, Texas, near Austin. After years of struggling, the Texas State University special education major knocked out her math requirement during a summer class that met from 8 a.m. to 2 p.m. five days a week. She now works as a math tutor.

"This program has literally changed my life," she said, adding that figuring out a tip at a restaurant used to make her panic. "It gives people a second chance."
